Q: Serving papers- I’ve been living in FL for about 5 months (not legal resident yet) and I snail-mailed my husband papers,
(which he has just received) he agreed to sign and mail back to me. Now he tells me he has retained a lawyer who advised him not to sign, but instead serve me. What can I do to remain the original plaintiff? And does it matter?
A: In a divorce case it does not matter who the Petitioner is. To protect yourself, if he files first then you should file a Counter Petition.
