Tampa, FL asked in Contracts and Consumer Law for Florida

Q: Trading in a car

My ex husband is driving a car that he had my dad co-sign for when we were still married. He just told me that he is going to try to trade the car in and have his mother co-sign for him to get this new car. Will he be able to trade in the car without having my dad there? My father wants nothing to do with him and will not drive an hour away to do this. Any help would be appreciated.

A: Depends upon the wording of the names on the actual car title. If your ex and your dad are listed as OR then either of them without the order can sell or trade the car.

Hope this helps.

A: The good news is that the car loan your father signed most likely needs to be paid off in order for title to the car to be transferred.

The answer to your question about whether your father needs to sign the title depends upon how the car was titled. There are many possibilities. The key is getting the original car loan paid off.
