Sevierville, TN asked in Employment Law and Employment Discrimination for Tennessee

Q: Do I need a lawyer? I believe I was wrongfully discharged.

July 2016 I was a current employee of three years, who was asked to take a urine drug screen due to reasonable suspicion based on an anonymous phone call only. I asked who called and was told they didn't know. I consented verbally and was observed and tested on site. The drug screen was negative and I went back to working. 9 days later I received a call from an MRO who said my drug test was positive for 15ng of cannabinoids. I told him I already passed a drug test. He said this is the confirmation and the cutoff is 10ng, which is false. He reported a positive to HR. I then received a phone call from a lady in HR and I asked her was she aware that I had passed the drug screen. She said yes and I asked what was happening. She said, "I know you are scheduled to work tonight, but I cant let you come in." She said I was discharged. I asked her for what? She said for gross misconduct. Isn't this a violation of state testing laws?
