Murrieta, CA asked in Animal / Dog Law for California

Q: My puppy was killed by a pitbull at the dog park. Do I have any case? We took him in the big dog s ide?

As many times before, took my small poodle mix to the dog park with no problems. We have large dogs that were usually with us so we didn't have a choice of side. One day we didn't have the big dogs with us and walked into the big dog side and 1 minute of walking in a pit bull walked up to my small dog and chewed him up killing him. Can I do anything because we were on the large dog side? I filed a report with animal control.

A: Your claim is limited to the dollar value of the poodle. Dogs are considered property, so the compensation is limited to the value of the property. Being at a dog park doesn't waive your claim.
