Mchenry, IL asked in Criminal Law and Traffic Tickets for Illinois

Q: Is there a law in Illinois about a minimum amount of days before an initial court date? driving on suspended lic. charge

Got a driving on suspended ticket (license was suspended a week prior with no notice at all) and was scheduled court about 20 days later. I've heard about a law that it needs to be at least 30 days out. Anytime I've had court it was 30-45 days out in the past. Also curious on what the out come can be... it was suspended a week prior and valid again 3 days later.

A: You are going to find that the police agencies probably have “key dates” for intiial court appearances and the judges recognize those.

Update your address with Sec of State. Notice probably went to an old address.

A: As to what could happen in court, if your matter is in Cook County and you now have a valid DL it is likely the driving on suspending ticket will dismissed. Most other counties, you will receive court supervision if you are eligible and a fine.
