East Stroudsburg, PA asked in Child Custody for Pennsylvania

Q: Father travels extensively with work. He is now seeking 50/50 custody. Chances?

My STBX has traveled extensively with work our entire 20yr marriage. After requesting the divorce, he stopped traveling and worked exclusively out of the home. He put cameras in our home to try to provoke me to say or do somethong wrong. He initially proposed 80/20 custody in writing but changed his mind and is now seeking 50/50 custody likely due to the amt of child support he has to pay. I moved out of the home because I could not afford it even with my expected support. He wouldn't temorarily stay or work outside the home and the cameras frightened me. Our 19yr old is going to stay with me exclusively on her college breaks. Our 16yr old wants to stay primarily with me as well. Our 9yr old obviously has not been asked or expressed a desire either way except that he calls nonstop when he is with his father. I have been a stay at home mom for 19yrs and now have a part time job that allows me to get our 9yr old on and off the bus. What are his chances of getting 50/50 in PA

A: So, your header says he travels all the time but the body of your question seems to say that's stopped. Let's assume that's what you meant - he's not traveling extensively any more. There are 16 factors the court reviews when making a custody determination. I'll give you the link to the custody law and you can read them in sections 5328-5330. Then I suggest that you discuss the particulars of your case in person with a local attorney well versed in family law. We're not in the business of laying odds on the result of court cases but, knowing all of the factors in your case will assist an attorney in giving you far more helpful advice that those of us on this question and answer site are able to.
