Worcester, MA asked in Child Custody for Massachusetts

Q: can i request that my child not ride with his grandfather who has severe alcohol induced neuropathy.

My ex father in law needs to use a walker and falls often yet he is still driving. I fear for my child's safety. Would the court generally be in my favor in this matter

A: Yes, certainly that would be a risk to their safety and well-being and allowing this to occur could well be neglect . You should go over the details of why this is occurring during visitation?? I am assuming you and father are not together and that either divorce or paternity Judgment exists or there are temporary orders. If the case has gone to Judgment then there needs to be a discussion on Modification or reviewing temporary orders due to this circumstance as soon as possible.
