Q: How can I stop a foreclosure sale that is set for Dec.6th 2017, if my BK was dismissed with prejudice?

How can I stop my foreclosure sale of Dec. 6th if BK is no longer an option but I will be able to come up with the funds? My Chapt. 13 BK was dismissed w/ prejudice, so that is no longer an option to stop the sale. I can come up with lump sums, but the bank wants the amount in full, which is understandable. What are my options to postpone the sale date, as I will be able to come up with the funds, just not by the Dec. 6th sale date...I just need 2-3 months, MAXIMUM. Are there any motions or something that can be filed to possibly halt the sale?

A: You are entitled to reinstate the loan by law. The bank does not have to negotiate with you on reinstatement amounts. Since the sale is now u fee 30 days out I am concerned you are out of time or almost.

Request reinstatement asap and pay the amount if you can. Or hire a lawyer in your area ASAP.
