Q: I signed a contract with a new waste service provider. Now my old waste service provider is in the picture

I have a dilemma I signed a contract with a new waste service provider they gave me a better offer. New provider said they would take care of everything from removing old trash bin to closing my account. A representative from the old waste provider came to my businesssaying they have a right of first refusal in my contract. To sum it up he said that my new provider wouldn't pay whatever fees are owed to my old provider since he said other customers are in that same situation. Apart from that he said I would be stuck with two contracts. He is saying that if I sign his contract that the contract I signed with the new provider would be voided. The thing is my son signed the contract with old provider but he is not listed on my account. Apart from that the name of the business has changed and on the contract was the name of the old business Just want to get someones opinion on this and where I stand.

A: It is very hard to truly understand and evaluate your situation in this question and answer format- a lawyer needs to see both contracts and get the facts straight. However, the most important thing I glean form you question is the statement where you say "my son signed the contact"- are you saying he signed your name ( acting as your representative ( with a power of attorney) or did he sign his own name. You are not bound by any contract unless you signed it, or you authorized someone to sign it for you. All the other stuff in your question about "right of first refusal" and/or "voiding" the other contact requires a review of the actual document. Get a lawyer to check it out for you.
