Q: Landlord won’t let me out of lease for medical reasons

My daughter and I live together in a 2bd apartment. Mother is disabled, relies on daughter for help. Mgr. won't let me out of Lease. My daughter got a restraining order against physically abusive ex-boyfriend. She was released from her rental contract to escape domestic violence but landlord will not let her mother (myself,64 Yrs old) physically disabled in wheelchair, who depends on daughter for meal preparation, help bathing, transportation to doctors, etc., out of lease. I wrote landlord a letter requesting to be released from my rental contract as a reasonable accommodation for my disability, but landlord refused. When my daughter leaves for her safety, I need to go with her because she assists me with my day to day care. I am member of my daughters household, but we signed seperate rental contracts because the landlord required us to to qualify to rent here.

What can I do? I can’t afford nor want to hire another caregiver. Please help

A: Read the terms of your lease carefully. It probably provides for termination of the lease by either party. I am sure you can also cancel that lease due to economic hardship. Simply give the landlord 30 days notice so that she can find other tenants. But before you act, consult with a landlord-tenant attorney to make sure you are on sound legal grounds.
