San Luis Obispo, CA asked in Personal Injury and Health Care Law for California

Q: If the attorney has changed does the medical provider have to get a new lien with the updated attorney's signature?

I am a medical provider and have a few accounts where we had Liens on file but the Client/ Patient has changed attorneys. The Liens on file are signed by the previous attorney's office. Does a new Lien agreement need to be signed by the attorney now in charge of the case or does the Lien agreement get transferred from the previous attorney's office? Is the Lien signed by the previous attorney still active even tho they are not assigned to the case any longer?

A: to be safe i always advise doctors to get a new lien...........thus locking in the new lawyer.

when case settles if the attorney has not signed lien and the client ORDERS him not to pay the lawyer is in a difficult position and i suspect would not pay........as would be the case if it happened to me.

a lawyer has to follow a client's orders.
