Center Moriches, NY asked in Landlord - Tenant for Virginia

Q: our rental management office charged us $1325 for a mold test we never asked for. If we don't pay can they evict?

They say if we don't pay by Jan 1st, our rent payments will go towards this charge and we will be in default of the rent and they will start the eviction process. The city inspector cited them for mold. NO one told them they had to do mold testing.

A: In Virginia, generally the landlord is responsible for the maintenance of the premises in a landlord-tenant residential lease. The responsibility can be placed on the tenant if it is stated as such in the lease. You should carefully read your lease to see what its says about mold and the maintenance of the premises. If you think the landlord has charged you improperly, you may have to file a lawsuit so a judge can decide the outcome.
