A: You need to talk to a probate lawyer but not necessarily file probate. Probate lawyers do a lot more than just handle formal probates that are filed in the court. You might be able to access bank funds if the amount is very small based on an Oregon Statute. There is a proceeding for smaller estates that is simpler than a full probate. But this is a difficult area so you definitely want to talk to a probate lawyer first.
