Spring Hill, FL asked in Child Custody, Criminal Law and Family Law for Florida

Q: I have joint custody. Ex is in jail. Can I send my child to live with family out of state?

My child skips school and is a habitual run away. State programs have failed us as a family. Can I send her to live with family out of state with out being in contempt? Can i sign a POA to my aunt and uncle and have her live with them, all while i support her? Will this cause any issues for me in florida with my other two minor child? Will I have a back lash with custody? I don't want to loose my other children, due to the one unruly child. I just want better for her.Ex husband is order to pay child support, has not made a single payment he is $11,000 behind, he's in jail, and does not have any communication with the children.

A: I don't believe that would be a problem. Does the custody order (or time-sharing plan) indicate specifically that the child cannot be taken out-of-state?
