Q: Can i be made responsible to pay lot rent if my mobile home has been condemned?

I recently recieved a mobile home from my grandma and a few weeks later the city had put a condemned sticker on the front door saying no one could enter or live there. It had been like this for 4 months as i am in the process of trying to sell it to someone who has the time and money to fix it up. I found a buyer and now the land lord is saying that i must pay 4 months of back rent that havent been paid. I stoped paying as i was u der the assumption that si ce it was condemned i wasnt responsible to pay. The land lord never tried to contact me or anything about paying rent on the lot until i tried to sell it. I have no signed lease or anything with this landlord. I got the place from my grandma and the owners knew and never came to me to set up any arrangements. The first time i paid the rent i gave it to my grandma and she gave it to the landlord as she lives in the same park she turned it in for me when she paid her rent. Just wanted to know if i have to pay the back rent or not.

A: While it would be worthwhile to have a lawyer review your mother’s lease, it is rather likely that the lease gives the landlord a security interest in the mobile home parked there. If so, you can probably walk away from your mother’s lease and assets, you might not be able to take the trailer assets and leave the landlord holding the rent. A review by whomever is handling the probate would be useful.

A: I do not all the facts of your case but I suspect the landlord who owns the ground on which the mobile home is located is renting that lot so the landlord is owed rent for the lot.
