Q: If im being sued for child support but pay child care expenses and take care of my child, would I have to pay?

A: There are a number of factors involved in determining a child support obligation, including each parties income and custody time with the child; thus it is not possible to determine from the facts provided whether a support obligation would exist.

That being said, the court may deviate from the base support amount to account for child care expenses, health insurance premiums, unreimbursed medical expenses (such as co-pays and co-insurance payments), and mortgage costs. Generally, child care expenses, health insurance premiums, and unreimbursed medical expenses will be apportioned between the parties relative to their incomes. Therefore, the parent with the higher net monthly income will pay more for these expenses.
