Cerritos, CA asked in Personal Injury and Education Law for California

Q: What can I do to fix this?

I am 17 years old and the ASB President of my high school. My ASB Vice President, also 17, filmed me naked in the shower during our school retreat and showed everyone the video of me naked--ridiculing me. She replayed the video multiple times, despite me being naked. I felt completely violated, and in addition to that, I also injured my upper-right back from hitting the shower handle. For months now, I have been under emotional distress while the school did nothing to help me. They only suspended her (and another girl) for 3-4 days, and they were allowed to remain within the program with no repercussions. In fact, my ASB Advisor also forced me to award this bully with "ASBian of the Month." I feel like the school has neglected me and punished me with missing school days, left me incapable of completing classwork and effectively learning/catching up on missed material, and makes me feel unsafe from entering campus. Nothing has been done to help me.

A: You can file a police report. What happened to you is a crime. Several crimes, actually. You can sue her for invasion of privacy and a number of other claims. Since you are 17, this has to be done through a parent, or other adult. It is possible that their may be claims against the school, but you have 6 months to file a Claim against the school.

A: As to the distress get counselling--look for counselors who do EMDR as it would be the fastest result for you.

On the legal end, look for a member of CAOC who handles education/school related claims in your general area.

All the best for dealing with this. Make an amazing college entrance essay some day if done carefully.

A: try calling the superintendent of schools.

you can hire a lawyer who handles this area of law to sue her for damages but i think few lawyers would take the case on a lien.

the best result might be to sue her in small claims court through your parents.....they should have been fighting for you all this time and making a stink.

you can not have a lawyer in small claims and your case will be heard within a few months rather than a few years.

i would send her a demand letter setting forth all the facts and setting forth how you were injured and if she does not pay you will pursue this matter with any civil or criminal remedies at your disposal..

did you make a police report? what she did was criminal. i would have her arrested............technically she posted porn on the web

she will not respond and i assume you would attach the letter to the complaint you file with the court.
