Q: How long does an adjuster have to look over a claim in the state of Virginia by Law ? Is there a time limit ? Thanks !

Hello, can you please tell me if there is time limit an adjuster has to look over a bodily injury claim in Virginia ? The adjuster told me 21 days...but not sure if that is accurate. thanks !

A: I believe there is no set time. The only set time is for damage to a vehicle or other property. However you should have spoken with a member of the Va. Trial Lawyers Assn before you spoke with the insurance.They give free consultations.

Speaking with the insurance, sounding super anxious to settle lets them get information out of you while they wait to see how hungry you are and how little they have to pay you. Use the time they are taking to get a free consult.

A: There is no specific time limit for an adjuster to respond to a personal injury claim demand. It varies by company and by adjuster, depending on their caseload. It is not unusual for it to take 30 days or more for an initial offer. Hopefully, you are not anywhere close to the statute of limitations date (two years from the date of the accident).
