Middletown, OH asked in Family Law and Child Custody for Ohio

Q: What options do I have

I am the father of my 2 year old son. After his birth he was given her last name. she has since hit me for child support which I pay, but she refuses to let me see him or be anywhere near him. I am not even allowed to give him his birthday or Christmas presents. I was told to take them to her father and he would make sure he got them. I just want to be in my sons life I miss him and love him too much for this to become the norm. There has been no time in a court room nothing just the child support agreement and that is it. She makes a point of calling me a dead beat who doesn't care about his child when she is the one that refuses to let me be a part of his life. Please what options do I have if any. How should I go about getting my son back.

A: Until a court grants you parental rights, the mother is the sole custodian and makes all decisions about the child and whether anyone gets to have contact with the child. You must file with the juvenile court to establish paternity and then seek parental rights. The court will determine if and to what extent you can have contact with the child, based on facts and testimony presented to the court, to determine what is in the child's best interest.
