East Berlin, PA asked in Family Law and Child Custody for Pennsylvania

Q: My ex girlfriend and I broke up a year ago can I take my kids and move out of state?

Well she started just staying on her phone all the time and when she is with this guy it’s like the kids don’t egsist anymore. She stopped being the mother she was before. After I came home from working the night shift I asked why she hadn’t changed our 2 year old daughter who’s diaper was leaking pee and reaked of poop. She blew up and yelled she was a mom for 14 years and she’s done changing diapers. She has four kids from previous marriage. At the time my son was just learning his potty routine in which I was doing by myself while I worked nights and slept a little and woke up to feed the kids stop the fighting homework and even took the older 4 to the drop off for their dad to pick up. I lived here over this passed year for the kids I got hurt at work which has really hurt me financially. She acts like a mom when eyes are on her but when they are not I have to stay awake and take care of them. She’s has gone against some parts of her custody agreement. I fear my two wont survive

A: Before you move out of state, you must follow the PA custody laws and provide her with written notice of your intended move. If she objects to the move, you would need court permission to relocate. Please take this very seriously as moving without complying with the notice provisions could result in you being forced to return the children to Pennsylvania or even worse losing custody of them.
