Highland, IN asked in Traffic Tickets for Indiana

Q: Failure to stop ticket. Is there a law that allows me to protect property?

The officer said I did a "California roll" . I was in my friends car and the road was really narrow. As I was comming to the stop there was a driver comming right down the middle of the road with on comming traffic from the other side. If I didn't cut my stop short I would of gotten damaged.I said not guilty. I'm gonna go back and measure the road to prove 3 cars couldn't fit and if I didn't move I would of gotten scraped. I tried explaining to the officer and he wasn't having it. Also would a signed affidavit work as testimony for my witness as I don't think he could get off work. And if I am proven guilty will my fine be more? Or worst case scenario?

A: You may want to consider hiring an attorney to represent you and convey all the facts to the prosecutor. If you take it to trial the standard the judge must follow is preponderance of the evidence; if he believes the officer 51% and you 49% you will be found liable. This offense would very likely affect your insurance rates and add I believe 4 points to your record.
