Q: Rear ended in PA auto accident. Had X-rays, PT. Am I entitled to any more than just the cost of the medical bills?

Accident was 09/2015 and I just received a call regarding payout. Some of the medical bills are in collections now. The payout is equal to the exact costs of the bills (which some were negotiated down). Is PA a state where you are able to be granted 3x the total amount of the bills?

A: You would need to consult a lawyer. If the accident was in September, 2015, the two year statute of limitations has run, such that you would be barred from pursuing a claim.

A: In no state is there an automatic "payout"

Your insurance would cover the bills. However, unless you were under 18 at the time, you have a problem if you did not sue the other driver as the statute of limitations in Pennsylvania is 2 years from the date of the wreck--if it was September 2015 you had until September 2017 to bring a case--right now you don't have one if you didn't file suit and were 18 or over at the time of the wreck.
