Riverside, CA asked in Personal Injury, Civil Rights and Gov & Administrative Law for California

Q: counsel decides not to move forward with the case and doesn't answer 3rd party complaint, what is outcome

Civil rights claim v. County and sheriff's dept.

The plaintiffs attorney decided to not proceed any further on the case, would not give reasoning just simply stated that he filed an excellent lawsuit, and we should be able to get a decent lawyer to finish the case out. In the meantime the county filed a 3rd party complaint to which an answer is due in a few days. If the filing lawyer doesn not submit the answer by the due date. What does that do to the case. Mind you the incident occurred in Oct 2016. And complaint was filed in September 17

A: a lawyer would need more facts.

however if a lawyer files and dismisses the case then your case would be over but cross complaint may still be alive.

if the lawyer decides the case is not worth it for him and he just subs out to another lawyer or asks you to sign sub of atty or asks court to relieve him then he is out.

however there is still the cross complaint to be answered. However if you drop your case maybe you can talk the other party into doing so too.

normally a good lawyer will not leave you dangling and make decision like this at the last minute.
