Q: How am I able to retrieve my refund from the aftermarket warranty I cancelled on a used vehicle I purchased in 2016?

I signed an arbitration agreement when I purchased my used vehicle. The dealer gave me a partial refund of $2,000 but they won’t disperse the remaining $400. However, I’m weary of filing a claim for arbitration because it’s my understanding that since the auto dealer gets to pick the arbitrator, I won’t get a ruling in my favor (even though I know I’m in the right). Under the circumstances of my case, will I be eligible to file a small claims case or must I go through arbitration? Vehicle was purchased in Burbank, CA

A: If the terms of the warranty are that disputes are to be resolved through arbitration, then that is where your claim must be pursued.
