Jacksonville, FL asked in Family Law for Florida

Q: We have 2 children. I have one and she the other. 1 turned 18 in Dec but will not graduate until June. Court papers show

No support to be paid as we each have 1 of our children. Eldest is now 18 but still in high school till 6/18. he will then attend college. Since both children are ours together will child support be owed to the parent with the minor child after high school graduation of the eldest one? Keep in mind both of these children are both of ours

A: I'm assuming that the child support order provides that each parent will pay child support to the other until each child graduates. If so, the parent with the custody of the youngest child will received child support after the oldest child graduates until the other child graduates. But if it doesn't say that, child support ends at age 18. In either case, it appears that whoever drafted the order made an error and the child support amount will have to be determined.
