Spring Hill, FL asked in Landlord - Tenant for Florida

Q: We paid the small past due amount of rent per the 3-day notice but landlord is still trying to evict.

Our landlord accepted our payment of late rent (we were short $390 and they accepted it the day after our 3-day notice). However, their 3-day notice included other stipulations (a new 1 year lease agreement which they have now changed to a 6 month lease agreement and other stipulations). To my understand, the 3-day notice can ONLY contain the rent that is past due. I did speak to one attorney who said there is a Florida statute that states if they accept payment even though we are in default, they can not file for eviction or demand anything else as we are no longer in compliance. We advised the landlords we do not agree to the new lease and are staying with our current one. They have told us that we are still in default because of the other stipulations they demanded on the 3-day notice and if we don't agree and sign, they will start the eviction process. This cannot happen correct? Please help!
