Q: Can i still get child support if i give my baby another mans last name that isnt his fathers?
I have a 5 yr old son and im 6 months pregnant. I want nothing to do with my unborn babys father because i cought him using drugs. My sons father wants me to get back with him and give his last name to the baby. Will this affect any child support for the baby? Or will the baby be my sons fathers responsibility now?
A: The name that is on your child's birth certificate does not prevent you from obtaining child support from your child's father. You should consider filing a paternity action to ask the court to determine the father of your child and set child support and custody orders. If paternity is denied, the court can order DNA testing.
