Q: I got hit from the back left side of the trailer California police report came agist me.

7:30 am sunny day i-15 highway san bernardino CA. The accident happened in 3 lane highway i was doing the truck speed limit 45 mph and i was in the center of my lane. Cars can go 70 mph I saw a silver car was behind me and started passing me but she hit the back left side of the trailer i stopped after i saw her hitting another car i went to check on them and the car driver who hit my trailer asked what happened i said I saw you crushing with the black car. And she told me she hit something that she doesn't know what is it. I went back to my truck. police came they asked me which lane I was in, I told them I was in the third lane if you count lanes from left to right i wasnt on 4th lane cuz i noticed it will end and I told him the silver car was behind me and started passing me. The police report came out against me stating that I was on 4th lane and I merged lane improperly without using my turn signal. How can I fight this false report I have also pictures of the accident.

A: Police reports are not admissible. However, if there were witnesses, there testimony is admissible. Regardless, your own collision insurer will repair the vehicle, whether you are at fault or not. You will pay a deductible, but if the other party is at fault and your insurer recovers, your deductible will be refunded. If you were hurt, speak to a PI attorney.

A: If you want to fight it, hire an attorney that fights tickets regularly at the superior court where you have to appear to fight your ticket. Best of luck.
