Marlton, NJ asked in Civil Rights and Criminal Law for New Jersey

Q: Some people have said you should sue the police violated your rights. I will briefly describe my current stuation.

The other night 3 minutes after leaving work we got pulled over for a headlight out. Nobody was doing anything suspicious there was no aroma in the air just a normal stop. I was a passenger in the car that was pulled over. My dl is suspended that's why I car pull. When the police officer saw the drivers dl he noticed it was a probationary license and said that driver wasn't suppose to have more then one passenger in the car or wasn't suppose to be driving after 12 unless coming from work which the p.o. recognized that's where we just left. It was 110 am aND our shift was 3 to 1. The p.o. asked if anyone else had a license and I replied no I don't mine is suspended then he asked for my info I willingly gave him it then he checked us out. I had no warrants but I do have a record. Immediately I was ordered out of the car and placed in handcuffs, then told he wants to search me. Then k9 was called nothing turned up in vehicle but it did on me. Is my past probable cause? How is this legal?

A: Your friends may be right, the problem is that many civil rights lawyers want you to pay them upfront for filing a case, but call around.
