Morro Bay, CA asked in Libel & Slander for California

Q: Can someone sue me for "defamation" when I simply exposed their Instagram Ponzi scheme?

Recently I've felt bullied by a Ponzi scheme I exposed on Instagram. Multiple accounts that spam post to get huge followings (against Instagram Terms of use). What can they do legally? They have said they will sue me for defamation. I simply posted on my story exposing this girl switching accounts out of nowhere from 2.5k followers to 100k followers. So it can't be defamation.. because I wasn't wrong. Lots of proof that this guy gave her the new account with all the followers (also against Instagram ToU). But he sees it as me meddling with him and a client's business.

A: You can never prevent someone from suing. However, without getting into the details of the facts and Instagram's ToU, if you have simply made true statements, you will prevail in a defamation action. The same goes for posting an opinion, if the facts upon which you base your opinion are true and disclosed.
