Q: I have mold coming from my HVAC. I noticed mold growing on the coil inside my apartment, took pictures .

In the meantime I had been getting ill for some time not knowing why. I showed the pics. to manager and she said NO, the is dirt! She refused to do anything, so I paid for mold inspector and the found mold to be 11000 inside and 500 outside. Long story short they were supposed to comply by remediation as they said they would, but just had carpets removed and replaced, wiped down walls, and cleaned inside ducts only about 3 feet. They did not even disclose to these companies that it was mold related. So I wound up with a worse situation, mold was spread over my apt. worse and I am getting very sick. They refused to do anything else and said they spent enough money trying to satisfy me. I have had to sleep in my car many nights as I have no where to go and cannot afford to move this is senior low income apt. Life is miserable and you can see white powdery stuff all over my furniture when I put air cond on! Eyes, nose, skin and many other health problems, what should I do, also out $375

worst case scenario you can sue in small claims court for up to $10k

try to prepare a detailed summary of what happened and when.

try to remember dates you slept in car.

have you told all this to doctors? what docs have you seen? what have they said.

A: You will need detailed epidemiological records identifying the mold spores in the apartment (maybe the mold inspector has already done this) and medical records establishing that those spores caused the health conditions of which you now complain. It is not easy. You have no chance of a personal injury claim without medical substantiation.

Call your County Dept. of Health and make a complaint. Contact a landlord-tenant attorney regarding your right to deduct the cost of the mold inspection from your monthly rent. Contact a PI attorney about an elder abuse case. Go to the doctor.
