Q: If i moved out of NJ 6 months ago, but without father consent, does NJ still have jurisdiction,

He hasn't contacted me about seeing my child in over 6 months and I have not contacted him, he doesn't know we moved. But I'm afraid he'll find out, and try to make things diffucult for me because that just how he is. Last time we were in court he asked for joint legal custody, and was denied. He asked me to take him off child support, and he would dissolve the court's visitation order. We went into a consent order saying "we don't want the courts help in regard to custody, visitation and child support, and would like the visitation order dissolved,. Before I moved I offered him supervised visitation but he never showed for it, he had not contacted me and I have not contacted him. Hypothetical if he did take me to court, would he have a case since we moved over six months ago, and he never asked to see her, plus he dissolved the old visitation order.

A: Technically you have kidnapped the child. You cannot leave the state of NJ without a Court Order granting you permission. You really need to consult with a NJ matrimonial(family law) attorney. Good luck.
