Scranton, PA asked in Estate Planning for Pennsylvania

Q: I assigned my mother’s life insurance to the funeral home. Can I have my 2 siblings pay their share to me?

I was not told by the funeral director that I could cash my mom’s life ins as the sole beneficiary and then pay him my share. Instead he said it would be quicker to ‘assign’ the policy to him. Can I have the estate pay their share of the funeral bill to me or somehow get them to pay me? All 3 of us are in her will to receive 1/3 of her estate. We all live in Pennsylvania.

A: The funeral bill is completely payable by the estate and you should have the estate reimburse you for the entire bill as the estate gets a tax deduction for doing so. If all or some portion of the bill is paid by life insurance, there is no deduction for that portion.

The funeral director should not have asked you to do that and he should know better.
