New York, NY asked in Landlord - Tenant for New York

Q: I have lived in an apartment without being on the lease with my daughters from 1998-2009. ..

The original tenant on the lease left me the apartment in 1998 and left to another country. She never put me on the lease. I have payed rent all those years. In 2009 I left the apartment to relatives and they have payed the rent. Recently, the apartment burned down and now the original tenant that gave me the apartment wants the apartment back. What are her rights? What are the chances of me being charged and my rights?

A: If it burned down what apartment could anyone get back? Unless you are an arsonist and burned it down, you cannot get "charged" with anything.
