Port Huron, MI asked in Contracts and Real Estate Law for Michigan

Q: Paperwork is all over the place? I signed paper work 3/2012 For $407 per mth but i pay him $450

We received paperwork on 7/2016 we owed 26,044 as of 6/2016. Now 11/2017 received paperwork it shows 6/2016 that we owe 22,935, also he has been taking our payments and adding them where needed(no late fees)(ever) the last payment given was on 10/2017 (this don't make sense) added to 9/2015 with a balance of 24,136. 2017 tax info dated 1/1/17 principle 25,651. I need help..he then proceeded to send me this//Our accountant David Pillon will meet with you on Tuesday the 20th if you can be here between 3:00 & 3:30. His normal hours are 8:00 am to 2:00 pm. He has agreed to stay late on Tuesday. I do not wish for him to stay late unless you can provide documentation to support your claims. If you wish to dispute the # of payments you have made on the land contract you will need to bring receipts for all the payments you have made. You have not made anywhere near 66 payments and I am sure you cannot produce anywhere near that # of receipts

A: Your question is VERY unclear. I assume you have a land contract and you're disputing the payments made and/or how they were credited.

Do you have proof of payments and have you run an amortization schedule with those payments? Does it match what is listed in the paperwork provided? You cannot 'prove' payments without cancelled checks or receipts or some other documentation.

Bottom line. 1) It is unclear what you are asking and 2) It IS clear you need to show all the paperwork to a local real estate attorney who can review the situation and provide you guidance.
