Ladera Ranch, CA asked in Criminal Law, Civil Litigation, Civil Rights and Small Claims for California

Q: CA HSC 11350. 2 days jail, 2800$/phone confiscated. In 98 camry, on Wed Sep 13th, at approximately 8:00 pm

I traveled out of a shopping center onto the first lane to the right and immediately upon doing so came to a typical stop at a red light 4 laned intersection as the foremost automobile in said lane. Before the light changed to green, I realized I hadn't yet engaged my standard headlights and did so immediately, however, at the exact same time I noticed that there was a sheriff's patrol vehicle accross the street perpendicular to me and to my right. My light turned green first and I proceeded to travel in a safe and normal way across the intersection. The only other occupant of the automobile was my sweetheart in the passenger seat, and we both had our seat belts on. The sheriff pulled out behind me and immediately turned his emergency lights on and possibly sirens also. I drove slowly and used my blinkers to indicate I was attempting to pull over at the first safe spot, but for safety not immediately on the narrow shoulder of the main road like the one I was on. Can i sue 1983 no PC?

A: To properly evaluate any legal question a lawyer needs a thorough summary of the facts.

This involves not just your interpretation but what the other side is saying too.

If you are not clear then the lawyer will no doubt be challenged to correctly respond. It is the old adage: “Junk in, junk out”.

On any legal question you should contact a local lawyer and present him/her with ALL the facts. That way your lawyer can talk to the DA or Judge to properly resolve your case.

Anyone can sue but in my opinion he had probable cause to stop you.

That does not mean you were guilty of anything.
