Q: How do I ensure my sister gets her proceeds of the sale of a home I own with my brother in law. He and I are on the deed
My sister's husband and I are on the deed of a home that we will be selling; my sister's name is not on the deed. She did pay half of their portion of the downpayment, and pays half of their portion of the mortgage each month. How can I assure that she can get her own disbursement check from the sale of the home? If he were to request this without my involvement, is that something that can be done? We will be selling at a profit, and I want to make sure that she receives her own disbursement in her own name. They may be going their separate ways soon, and I want her to have the money she is entitled to. Thank you! I so appreciate your sound advice.
A: You will have a lawyer I assume. At the closing, the seller will be asked how they want the checks to the seller cut, and your lawyer will say, and if you agree, the checks will be cut as you wish.
