Essex, MD asked in Criminal Law for Maryland

Q: How long must a individual what to have a criminal record expunged in Maryland?

If a person was charged with three charges from the same crime & in court two charges were dropped & the third charge was a plea of not guilty but given PBJ with supervision for 12 months. All requirements were met without any violations on the 12 months of supervised probation. No other charges have occurred since these charges were acquired & I'm trying to find out the amount of time that would need to pass before getting this expunged? I believe it is 10 years in Maryland but I am unaware if that length of time would change since the defendant was not found guilty technically speaking & was given PBJ on the charges. Thanks for any assistance with this question.

A: You may file 3 years after the date the pbj was granted (or if you were in probation more than 3 years then after you complete your probation). For good cause, a judge can grant an earlier expungement.
