Tarpon Springs, FL asked in Family Law and Divorce for Florida

Q: Legal?? my now ex husband secretly purchased a home in FL while we were still legally married but divorcing

He listed himself as a “single man” on the sales contract, warranty deed and I am assuming the mortgage. We were not divorced until 1 year after the purchase and I never knew he purchased it until I across it in the tax records 2 years later. The divorce was complicated with a large pre-nup to protect his corporation but the home is listed solely in his name. Do I have any recourse? Is he guilty of any fraud under Florida real estate laws?

A: The significant question is what is the source of the money he used for a down payment. If those funds were hidden from you, there may be grounds to re-visit the divorce terms.
