Q: What is the process, and potential costs involved for a gubnatorial pardon on a non-violent crime?

A: What is the crime for which you were convicted? This matters because there are a few crimes which are not allowed to be sealed.

A: For a first time pardon, the process is to

1. get certified copies of the following documents:

a. Judgment and Commitment Order (get from the Circuit Clerks Office if Felony Charge –or– from the District Clerk’s office if misdemeanor)

b. Felony Information and/or probable cause affidavit from clerk

c. Narrative incident report from arresting agency (City Police, Sheriff or State Police)

d. If record is sealed, include Order to Seal (get from court clerk)

e. If a sex offender, the last sex offender assessment report

2. Complete a pardon application

The application requires detailed information about the applicant's criminal, personal,

educational and employment history.

The applicant needs to be presented in the most favorable light.

There may be programs, treatment and other steps the applicant should complete to improve their odds.

These may vary by applicant.

For example, if the applicant is a sex offender, additional treatment or counseling might be recommended prior

to submitting an application.

Time and cost will vary as the attorney reviews and gathers information, makes recommendations, etc.
