Kill Devil Hills, NC asked in Employment Law for North Carolina

Q: Negotiated 6 mo severance paid over 6 mo, was laid off, they agreed to pay but now want to it claw back.

I negotiated 6 months severance upfront, paid over 6 months for company cash flow reasons, and have it in writing in my contract. I was laid off and the company agreed to pay. Now with the last couple of payments left they want to take it back saying that there was an outstanding invoice from a third party company that they didn't have (and I didn't) and want to dock that amount from my severance. I have no relation to the third party company but did approve the use of the company as a vendor, which was completely within my duties and my supervisor knew about it. The owner is saying that I should have been terminated for cause because of this and I would be owed nothing.

A: Get an experienced employment attorney to review the agreement and consult with you as soon as possible. Do not delay as it could prejudice your rights.
