Q: Consulting Agency created to solicit roof jobs in FL for state licensed contractor, with whom we have signed agreement.

I have created the agency to solicit jobs in SW FL. We are very upfront with our customers, and have the Roofers logo on all of our documentation. We do NOT market ourselves as roofers.

Is it legal for us to sign a contract with a homeowner for our consulting services, which includes the replacement of their roof? Out of these proceeds, we will then pay our licensed roofing partner for the labor to complete the roof.

I was told by the city of Cape Coral that the roofer is the only one that can make a contract, or accept any payment, with regards to a roof or any other construction. I was also told by a lawyer that said roofer would have to be on the contract, but roofer could then make my agency a payee (ie. Roofer A c/o Consulting Agency). I was told by a different lawyer that this is also not possible.

A: Honestly, I think that you are going about this backwards. You have apparently talked or consulted directly with an attorney and now you are on the internet seeking free legal advice. This site is designed to give answers to basic legal questions and is not a substitute for hiring a lawyer to represent you.
