Van Nuys, CA asked in Contracts, Business Law and Small Claims for California

Q: Hello, I am being sued by someone I do not even know.

Basically, I opened up a dba for a service based business however, i never did a single job because my business partner changed their mind. Years later which is recently, some folks come to my residence and my mom answers the door and they start yelling we’re going to sue you (they got our address from the court). They explained that supposedly I did a service for their aunt or grandmother, took the money and left (and it’s still broken that’s why they are upset). They left their number so I called them and said look I’m not the person your looking for and If you google the business name other businesses pop up with the same name ( yes these are the crooks, not me). After about a month now, I am being sued and have to go to small claims court. According to that person, who’s suing they (crooks) left them a invoice with my name on it. How do I prove and defend myself from these people ?

A: Bring proof of the existence of other businesses with your name. If there is a signature on the receipt/estimate/contract, show how your signature is different. Print out your Google Location Time Line, or Apple Maps Time Line for the period in question to show that you weren't at the location where the job was supposedly done. There could be an infinite variety of evidence on the subject. These are just a few ideas off the top of my head.
