Q: Can I sue the driver who hit my boyfriend’s car then claimed it was my boyfriend’s fault?
The other driver ran a red light, claims my boyfriend did, my boyfriend doesn’t have collision coverage and the other party’s insurance (Geico) states they have no independent evidence to show who is at fault so they can’t do anything. The police report is also nonconclusive to who’s at fault.
