Tampa, FL asked in Business Law, Civil Litigation and Contracts for Florida

Q: i left utilities in my name after selling my business until new owner could switch is she responsible for unpaid bill

Recently sold business to woman from uk here on visa. In our contract i agreed to remain an employee and manage business for 6mo as her visa stated she must do. I was handling utility bills and kept requesting they be switched, out of my name but she was rarely in the states to do so and now that i no longer work there and she has new person handling her finances while she's away she had them switched over with a balance due and my deposit kept as partial payment. What can i do about this? I have paperwork showing closing details and how i no longer owned business as of last year and new utility bills that are left unpaid accrued this year.

A: You would have to sue to enforce the terms of the contract.

A: It appears that your only option would be to file a lawsuit against her to recover the same. If under $5,000.00 you can bring the suit yourself in small claims. I suggest however that hiring a lawyer will be better in terms of knowing how to properly file the case. However, the cost of a lawyer may outweigh the funds you are trying to recover. If so, small claims appears to be your only option.
