San Antonio, TX asked in Child Support, Criminal Law and Family Law for Texas

Q: being sued for child support by a stranger. codes 160.607 and 160.204 are on the paper work. What can we do to stop it?

The name of the female who is sueing my husband has the same name as me except middle name, she has a daughter whose name is almost like our daughter. It seems like fraud. As if someone who is trying to take our refund. Is it that easy to do something like that?

A: This MAY be a clerical error. The court where the case is pending should be listed on the paperwork you received. You should file a written response with the Court, appear as directed, and explain you believe they have the wrong person. I suggest you contact a family law attorney in your area. Good luck.
