Q: If I was assaulted while I was in the nail shop is that considered their fault for not calling police or security?

I was in the nail shop getting my nails done I was approached then I finished getting my nails done when I was leaving I was assaulted and nobody did nothing not even police. I was kicked in the face while the whole shopping center watched and didnt help or call police. The police arrived with the man who assaulted me and did nothing. I went to e.r later that nite because i was scared to go to sleep with the injury and pain. What can i do if anything??

A: if the police know the man pressure them to file on him

the nail shop does not have exposure but they should have called police.

maybe they were concerned some of their employees were not "legal"???

A: If the police had the person who assaulted you and you gave the police a statement then they most likely didn't believe your version. Did you get the names and numbers of any witnesses. If you sue the person in civil court then those names and numbers will be needed. You should consult with a local attorney about a civil suit.

A: Unless the nail shop had actual knowledge of prior similar incidents of violence at the shop, it is not liable for the criminal actions of a third party. The police do not have an obligation to intervene, either.
