Arlington, VA asked in Immigration Law for Virginia

Q: Is Frequent travel to my home country on F-1 OPT EAD acceptable?

I am currently on my OPT EAD. It started in June 2017 and I have been employed since then. I went to my home country in Sept for 15 days and then in Dec for 25 days. Due to my father's ill health..I would again need to travel and I am planning to do that before April 1st..because after that my H1 would be filed and I will be restricted to travel outside US for 5-6 months.

Since I have already traveled outside US two times on OPT ( 45 days in total) and have OPT valid till June 2018 (I am eligible for extension but would apply for extension after my return) , I need to know if I can leave US again for a week's time. I would be back before 1st April (H1b Filing time). I have been in US since Aug 2016 which was the start of my course.

A: Sounds as if you’ve got a valid reason for travel, and it sounds as if you have a valid visa and a valid reason to be in the U. S. on that visa. Carry plenty of documentation regarding your need to return home as well as your connections to the US in any case.
