Spring, TX asked in Domestic Violence, Child Custody and Child Support for Texas

Q: How should I change court order to keep dad from kidnapping kids and taking out of school? He did it 4 yrs

He kept them in woods and no medical care, barely got them to school.and would not allow them to contact me. Eventually he surrendered 2 of the boys and kept other 3. One of those ran away and continues to live with strangers. One graduated high school and is homeless. The 3rd son lives with me but tried to commit suicide because mentally ill father said he would kill himself. He's been in counseling and doing better. All boys have ptsd and anger issues, depression as a result of physical, mental and emotional abuse by dad. Dad has been living in woods and has had no contact for 18 months and then called my son Sat night threatening to kidnap them again. What can I do to prevent him from taking them out of school? Divorce was final April 1, 2009. We have joint custody but I have primary custody. I need some legal papers to prevent him from doing this. He is $7,000 behind in child support and attorney general having trouble finding him to serve papers.

A: A person that lives in the woods under these circumstances is probably not going to be deterred by a court order. This is a serious safety concern for you and your children. Report the threatened kidnapping to law enforcement and consult a local family law attorney to determine what, if anything, can be done. Discuss with the attorney the possibility of moving far away and whether that can be done in a manner that does not threaten your custody rights.
