Q: In VA does my child support have to be re-ordered every time one of my 4 kids graduates or turns 18?

I have 1 monthly child support payment, all 4 kids are different ages. Do I have to go back to court when each one graduates and or turns 18?

A: As a general rule, it takes a court order to change a court order. So, you have to keep paying the ordered amount of support until a new order says otherwise.

However, whether to modify support depends upon what the new support would be. Sometimes the current support for three children may be more than the previous support for four children depending upon the changes to incomes, health insurance, etc. From the payor's perspective, one would not want to modify support to a higher amount.

A change to support does not necessarily require going back to court in the sense of a drawn hearing, etc. If the parents exchange incomes and run the guideline calculation, the court's involvement is simply to enter an agreed order that can be submitted through the clerk's office.
